Terms of Service

1. Description of Service

H4B is a business management platform designed for custom-order and service-based businesses. It provides tools for order tracking, client communication, payment recording, team collaboration, and customer order-status sharing. Features may be updated, added, or removed at our discretion, and we will make reasonable efforts to notify you of significant changes.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under applicable law to use H4B. By creating an account, you represent and warrant that you meet these requirements. If you are using H4B on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

To access H4B, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@handforbrand.com if you suspect any unauthorised access or security breach. We reserve the right to suspend or terminate accounts that we believe have been compromised or misused.

4. Demo & Onboarding

Access to H4B begins with a free 20-minute demo call where we assess whether the platform is a suitable fit for your business. Following the demo, onboarding is conducted personally by the H4B team. We reserve the right to decline onboarding any business at our sole discretion, including if the service is not a good fit or if there are concerns regarding intended use.

5. Subscriptions & Billing

After onboarding, continued access to H4B requires a paid subscription. Plans are billed monthly or annually (as selected) in Indian Rupees (INR) via Razorpay. By subscribing, you authorise Razorpay to charge your chosen payment method on a recurring basis. Prices are inclusive of applicable taxes unless stated otherwise. We reserve the right to change pricing with at least 30 days' prior notice to your registered email address.

6. Cancellation

You may cancel your subscription at any time by contacting us at hello@handforbrand.com. Cancellation takes effect at the end of your current billing cycle. You will retain access to the Service until that date. We do not prorate or refund partial billing periods unless required by law or specified in our Refund Policy.

7. Acceptable Use

You agree to use H4B only for lawful business purposes. You must not:

• Use the Service to store, transmit, or distribute illegal, harmful, or offensive content.
• Attempt to gain unauthorised access to any part of the platform or its infrastructure.
• Reverse-engineer, decompile, or copy any part of the Service.
• Use the Service to send unsolicited communications (spam) to your customers.
• Resell, sublicense, or commercially exploit access to the Service without our written consent.
• Interfere with or disrupt the integrity or performance of the platform or its related systems.

Violation of these terms may result in immediate suspension or termination of your account without refund.

8. Your Data

You retain full ownership of all data you enter into H4B — including order details, customer information, payment records, and business content. You grant H4B a limited, non-exclusive licence to store and process this data solely for the purpose of delivering the Service to you. We do not sell, share, or use your business data for any purpose other than operating the platform. For full details, refer to our Privacy Policy.

9. Customer Data & WhatsApp Usage

H4B provides tools that allow you to share order-tracking links with your customers via WhatsApp or other channels. You are solely responsible for ensuring that you have the necessary consent from your customers to contact them and share their data within the platform. H4B is not liable for any misuse of customer data by you or your team members.

10. Intellectual Property

All rights, title, and interest in the H4B platform — including its design, code, branding, and content — are owned by HandForBrand. Nothing in these Terms transfers any intellectual property rights to you. You may not use H4B's name, logo, or branding without prior written permission.

11. Third-Party Services

H4B integrates with third-party services including Razorpay (payments) and Cal.com (booking). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service.

12. Availability & Downtime

We aim to keep H4B available 24/7 but do not guarantee uninterrupted access. Scheduled maintenance, updates, or unforeseen technical issues may result in temporary downtime. We will make reasonable efforts to notify you of planned maintenance in advance. We are not liable for any losses resulting from service unavailability.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, secure, or suitable for your specific business needs. You use H4B at your own risk.

14. Limitation of Liability

To the fullest extent permitted by applicable law, HandForBrand shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business opportunities — arising out of or in connection with your use of or inability to use the Service, even if advised of the possibility of such damages. Our total aggregate liability to you for any claim under these Terms shall not exceed the amount you paid to us in the three months preceding the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless HandForBrand, its employees, and contractors from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

16. Modifications to Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, for material changes, notify you by email. Your continued use of H4B after changes are posted constitutes your acceptance of the revised Terms.

17. Termination

We reserve the right to suspend or terminate your access to H4B at any time, with or without notice, if we believe you have violated these Terms or if your account poses a risk to other users or the platform. Upon termination, your right to use the Service ceases immediately. You may request an export of your data within 30 days of termination by contacting us.

18. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Bihar, India. We encourage you to contact us first to resolve any concerns amicably before pursuing legal remedies.
